Article 1 – Definitions

In these conditions the following definitions apply:

  1. Reflection period: the period within which the consumer can exercise his right of withdrawal;
  2. Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with Little by Little;
  3. Day: calendar day;
  4. Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
  5. Durable data carrier: any means that enables the consumer or Little by Little to store information that is personally addressed to him in a way that allows future consultation and unchanged reproduction of the stored information.
  6. Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period;
  7. Little by Little: the natural or legal person who offers products and/or services remotely to consumers;
  8. Distance agreement: an agreement in which, within the framework of a system organized by Little by Little for the distance sale of products and/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement. ;
  9. Remote communication technology: means that can be used to conclude an agreement, without the consumer and Little by Little being together in the same room at the same time.
  10. General Terms and Conditions: the present General Terms and Conditions of Little by Little.

​Article 3 – General provisions

The e-commerce website of Little by Little, a sole proprietorship with registered office at Dokter Frans Hemeryckslaan 7/5, 2650 Edegem, BTWBE0785.620.618, offers its customers the opportunity to purchase products from its online store online.

These General Terms and Conditions (“Terms”) apply to every order placed by a visitor to this e-commerce website (“Customer”). ​Article 5 – Online purchases

​Choose the desired products in the webshop and click on 'Add to cart' to place them in your shopping cart. After you have placed all the desired products in the shopping cart, you can view the complete overview by clicking on the shopping cart at the top right of the page.

Once you have checked the shopping cart, you can continue with the ordering process by clicking on the 'checkout' button. You will now arrive at the checkout page. On this page you will be asked to enter your shipping information.

You can choose between collection and delivery in Belgium.

Once you have entered all the information, choose the desired payment method (Bancontact or credit card).

Little by Little is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.

​Article 6 – Right of withdrawal

The provisions of this article only apply to Customers who purchase items online from Little by Little in their capacity as consumers.

​The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons.

​The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the good.

​To exercise the right of withdrawal, the Customer must inform Little by Little, Dokter Frans Hemeryckxlaan 7/5 2650 Edegem, tom@littlebylittlesports.be, by an unequivocal statement by e-mail of his decision to withdraw from the agreement.

​To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

​The Customer must return or hand over the goods to Little by Little, Dokter Frans Hemeryckxlaan 7/5, without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to Little by Little. 2650 Edegem. ​The direct costs of returning the goods will be borne by the Customer.

The Customer is requested to return the items in their original condition and packaging.

If the returned product has been reduced in value in any way, Little by Little reserves the right to hold the Customer liable and claim compensation for any reduction in value of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to determine the nature, characteristics and operation of the goods.

​All returned items are carefully examined. The basic principle here is that the consumer may only inspect the item as he would in a store. Returned items may be tried on, but may not have been used. If an item has suffered a reduction in value due to the use of the Customer, this will be charged to the Customer.

​If the Customer revokes the agreement, Little by Little will refund all payments received from the Customer up to that time, excluding standard delivery costs, to the Customer. Little by Little may wait with the refund until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first.

​Little by Little will reimburse the Customer using the same payment method with which the Customer performed the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any costs for such reimbursement.

​Article 7 – The price

​​All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be paid by the Customer.

​If delivery, reservation or administrative costs are charged, this will be stated separately.

​The price statement applies exclusively to the items as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

​Article 8 – Delivery and execution of agreement

Items ordered through this online store are delivered in Belgium.

Delivery is done by Bpost.

​Orders can also be picked up by appointment at an agreed time and location.
For orders in Belgium, €5.50 shipping costs will be charged.

All products are shipped on the following Monday or Thursday.

​Any visible damage and/or qualitative shortcomings of an item or other shortcomings in delivery must be reported by the Customer to Little by Little without delay.

The risk of loss or damage passes to the Customer once he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Little by Little.

​Article 9 – Retention of title

The delivered items remain the exclusive property of Little by Little until full payment has been made by the Customer.

​If necessary, the Customer undertakes to inform third parties of Little by Little's retention of title, e.g. to anyone who would seize items that have not yet been fully paid for.

​Article 10 – Warranty

​​Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact Little by Little customer service and return the item to Little by Little at his expense.

If a defect is discovered, the Customer must inform Little by Little as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. Afterwards, any right to repair or replacement expires.

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the user instructions or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, or delivery if applicable, are deemed not to be hidden defects, unless the Customer proves otherwise.

​Article 11 – Customer service

Complaints procedure:

Complaints about the execution of the agreement must be submitted fully and clearly described to Little by Little within 7 days after the consumer has discovered the defects.

Complaints submitted to Little by Little will be answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, Little by Little will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed answer.

​If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.

​In case of complaints, a consumer should first contact Little by Little. It is also possible to register complaints via the European ODR platform ( http://ec.europa.eu/odr).

​A complaint does not suspend Little by Little's obligations, unless Little by Little indicates otherwise in writing.

​If a complaint is found to be justified by Little by Little, Little by Little will, at its option, replace or repair the delivered products free of charge.​

​Article 12 – Sanctions for non-payment

Without prejudice to the exercise of other rights that Little by Little has, in the event of non-payment or late payment, the Customer is legally liable to pay interest of 10% per year on the unpaid amount from the date of the default and without notice. In addition, the Customer is legally liable and without notice to pay a lump sum compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Little by Little reserves the right to take back items that have not been (fully) paid for.

​Article 13 – Privacy
